Jurisdiction

⚖️ Within the Nanotrasen, all ships within Nanotrasen space or registered under the Nanotrasen are subject to an abbreviated space law. All crew, passengers and visitors aboard a Nanotrasen ship, within Nanotrasen space or employed by the Nanotrasen are required to comply with this law. Common sense should be sufficient not to violate the law, the details of which are of particular importance to the New Frontier Sheriffs Department and the station administration.

Fundamental Rights

📜 The following fundamental rights are granted by space law to all Nanotrasen employees:

  • The Nanotrasen shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the employees peaceably to assemble and to present complaints to the Nanotrasen.
  • The right of the employees to be secure in their persons, vessels, papers, and effects against unreasonable searches and seizures shall not be infringed, and no search warrants shall issue without probable cause, supported by oath or affirmation, and particularly describing the place to be searched and the persons or things to be seized.
  • Unreasonable bail shall not be required, nor shall unreasonable fines be imposed, nor cruel and unusual punishments inflicted.
  • In suits at common law, where the value in controversy exceeds 50,000 Spesos, the right of trial by jury shall be preserved.
  • In all prosecutions for crimes punishable by death, the accused shall enjoy the right to a speedy and public trial by jury, except in cases where the accused obstructs the course of justice.

Sheriff's Powers

👮 The Sheriff of the New Frontier Sector is the primary authority on space law in the entire sector and reports directly to Central Command. The Sheriff is the leader of the New Frontier Sheriffs Department and is responsible for hiring, firing, demoting, or promoting members of the NFSD, as well as managing their salaries.

Rewards

💰 The Sheriff, or in their absence a station representative, may issue criminal bounties that can be pursued by any registered bounty hunters or citizen militias within the sector. Bounties must be issued with the crime committed, the affected parties, and a reasonable reward fund that is feasible to pay using station finances. Collected fines may be used to pay the bounty, but seized assets may not.

Pardons

🕊️ The Sheriff, or in their absence a station representative, may pardon employees who are accused or convicted of crimes if it is deemed to be in the best interest of the sector. Only minor and major crimes may be pardoned. Central Command must be contacted to obtain permission to pardon a crime that carries the death penalty. The Sheriff can be held legally accountable for criminal acts committed by those they pardon. Pardons must be announced via the communications console when they are carried out.

The Captain's Authority

The captain of a Nanotrasen vessel is the highest authority on space law aboard their ship in the absence of the NFSD, though they are held accountable for their actions by both their crew and the NFSD. They have the right to execute crew members under just circumstances, as well as the ability to hire, dismiss, demote, or promote crew members at their discretion.

Execution Rights

⚔️ The captain of a Nanotrasen vessel may carry out executions without the need for a trial under certain circumstances. This means they have the authority to personally execute any member of their crew if they are not already in NFSD custody. These circumstances would include threats to:

  • Authority: Attempts or threats to undermine the captain’s command, with the ability to do so, through illegal means.
  • Command: Attempts or threats to cause bodily harm to the captain or a member of the command staff in the captain’s presence, with the ability to do so.
  • Vessel: Attempts or threats to inflict physical damage on the vessel in the captain’s presence, with the ability to do so.

When an execution is carried out, the sector sheriff’s department must be notified of the death via fax, with details regarding the reason for the execution, the time of the execution, and all witnesses present at the execution. This must be done promptly, or the death will be declared as murder.

Mutiny

🏴‍☠️ If the captain or one or more members of their crew are found to be in violation of space law, they may initiate a legal mutiny. A mutiny is defined as a coordinated effort to legally depose the captain of a Nanotrasen vessel for committing illegal acts. In the event of a mutiny, loyalists are tasked with suppressing the mutineers using non-lethal force and should not resort to lethal measures, even if ordered to do so by the captain, except in self-defense. The NFSD must be called to handle the captain.

  • If the mutiny fails, only the crew members who led the mutiny may receive a death sentence, while all mutineers may be demoted and/or placed in extended isolation.
  • If the mutiny succeeds, the crew members who led the mutiny can choose the new captain. The new captain would ultimately decide the fate of the old captain.

When a mutiny begins, the crew members who initiate the mutiny must send a message to the administrators to inform the admin staff of what is about to happen, although no prior approval is required. If the mutiny is carried out without a valid roleplay reason, the participants risk being banned.

Legal Ethics

🧑‍⚖️ A lawyer has a primary duty to the court. Any statement made by a lawyer must not be intentionally false or lead the court to commit an error. If a lawyer becomes aware that a statement previously made is no longer true, or was never true, they must inform the court as soon as possible.

A lawyer has a duty to their client. They must act on the instructions of their client, zealously advocate for their client, and maintain confidentiality for everything their client has said, unless the client has explicitly waived that confidentiality. Evidence that results from a breach of confidentiality may not be used in court to convict or accuse someone of a crime. The duty of confidentiality remains even after the lawyer no longer represents the client.

If there is a conflict between a lawyer's duty to the court and their duty to their client, the lawyer must withdraw from the case and cease representing that client. An example of this is if a client confesses to committing a crime to the lawyer and then insists that the lawyer tell the court that the client is innocent. This is because the lawyer would be telling the court that the client did not commit the crime when they know it is a false statement. A plea of "not guilty" does not present this issue, as a guilty plea is a statement that the guilt cannot be proven beyond a reasonable doubt.

New Frontier Sheriffs Department

🌟

New Frontier Sheriffs Department (NFSD) is the primary law enforcement agency active within the New Frontier sector.

NFSD has the authority to detain a person suspected of criminal activity. A person reasonably suspected of committing a crime may be detained. During detention, the crew member will either remain at the location or be moved to a safer location, may be held back at the officer's discretion, and will remain detained for the time necessary for security to determine the circumstances of the incident and whether an arrest should be made. A detained individual can either be released or arrested.

NFSD has the authority to arrest a person for criminal actions. An arrest will occur when a detainee is formally charged with criminal activity. The charges must be brought by a member of security or the crew at large. Additionally, the sheriff, or in their absence, the station representative, can issue an arrest warrant with probable cause and take full responsibility for ensuring the legality of the warrant. Upon arrest, the perpetrator will be taken to a secure vessel for interrogation and processing.

NFSD holds a Class 2 weapon license and may be authorized to use deadly force to incapacitate opponents when they are at a significant tactical disadvantage or under threat to the sector as a whole. NFSD has the authority to monitor space within the New Frontier sector and is authorized to engage and subdue any threats to the station, crews, the sector, or Nanotrasen at large.

Members of NFSD, if they are charged with a serious crime or higher, or found to be acting in a manner unbecoming of a law enforcement officer, must be removed from service and downgraded to standard New Frontier personnel access.

Synths

All synthetic entities, including but not limited to robots, cyborgs, and drones, issued by Nanotrasen, created by Nanotrasen employees, or aboard a Nanotrasen vessel, are considered property of Nanotrasen, regardless of their origin or cognitive status. Damaging or destroying a synth is treated as damage to company property and prosecuted accordingly.

Pets

Contraband

All explosives, including but not limited to chemical, biological, electromagnetic, or thermonuclear, when aboard or docked to an NFSD vessel or a New Frontier station, are illegal for possession by Nanotrasen employees, except in cases where they are held for transfer to secure storage, or used by security personnel for their authorized purpose.

All drugs, including but not limited to space drugs, desoxyephedrine, stimulants, or any drug with the same or similar effect, are illegal for possession by Nanotrasen employees, except in cases where they are produced by a licensed chemist, approved by station administration, and provided to a patient with a prescription or stored in the chemist's secure custody. Only the prescription holder or the chemist may possess such drugs.

Classification of Contraband

Class 1 contraband includes all lethal, non-lethal, and less-than-lethal weapons that are not covered by higher classifications. Class 1 contraband includes but is not limited to firearms, melee weapons, laser weapons, and magic.

Crew members retain the right to possess non-lethal weapons for self-defense, but they are not allowed to bring them into secure areas.

Class 2 contraband includes all explosives, including but not limited to chemical, biological, electromagnetic, or thermonuclear. Class 2 contraband also includes all types of drugs.

Class 3 contraband consists of all stolen Nanotrasen assets, including but not limited to uniforms, equipment, and stolen goods.

Class 4 contraband consists of all prohibited items that have been classified as such by station administration or NFSD.

Search Warrants, Stops, Searches, and Seizures

Searches

NFSD has the authority to conduct searches of a person or their belongings if they have reasonable grounds to believe the person has committed a crime. A search must be reasonable in scope and duration. A search of a person should only be performed by an officer of the same gender as the person being searched, unless there are compelling circumstances.

Search Warrants

NFSD may apply for a search warrant from a judge if they have reasonable grounds to believe that evidence of a crime is located at a specific location. A search warrant must be specific regarding the place to be searched and the items to be seized.

Probable Cause

Probable cause is a lower standard than reasonable suspicion. Probable cause requires that an officer has specific and articulable facts which, along with reasonable inferences drawn from those facts, reasonably justify the intrusion.

Foreign Vessels

🚢

None of the following provisions, or any other provisions of Space Law, apply to vessels flying the flag of an organization at war with Nanotrasen, parties that have attacked a Nanotrasen facility, or vessels engaged in blatant criminal activity of a capital nature, except in cases where they operate within Nanotrasen space.

The station is encouraged to allow non-hostile visitors permission to dock or otherwise board under normal operational conditions. They may be searched upon arrival and escorted at the discretion of NFSD (Nanotrasen Federal Security Division). The visitor may request asylum, which is up to the discretion of a Station Representative to decide, and they will be given as much or as little access to the entire vessel as the Station Representative deems appropriate.

All visitors aboard a Nanotrasen vessel are subject to Space Law, and if a visitor breaks the law and flees aboard their own vessel, NFSD has the right to board it in pursuit. Nanotrasen employees aboard a foreign vessel are subject to the laws and policies of that vessel.

If an individual commits a crime aboard a Nanotrasen station and then flees to a third-party vessel, the captain of that vessel has the right to grant or deny asylum. The sovereignty of foreign vessels must be respected, and all decisions by their commanding officers to deny or limit entry must be respected.

Commercial Vessels

Commercial vessels are ships used for trade and commerce. They are governed by Nanotrasen's space law and are subject to inspection and search.

Commercial vessels are defined as those, regardless of origin, that are unarmed and operate in space for the purpose of conducting legal trade. An unarmed vessel should not be attacked without warning. It may only be fired upon if it repeatedly fails to stop when ordered to do so or resists boarding by an attacking vessel. The armed vessel may only intend to search for contraband (such as war materials, Nanotrasen contraband, etc.) when stopping a commercial vessel. The vessel may be allowed to leave, provided it is not allied with enemies of Nanotrasen, after any contraband has been removed.

However, appropriate measures must be taken to ensure the safety of the crew. In cases where a commercial vessel's crew is injured during a boarding, efforts must be made to rescue, revive, and clone them. This would typically involve taking the crew aboard and transporting them to a safe harbor. This can only be done if they are expected to reach safety on their own and have adequate supplies and navigation equipment to do so.

Essentially, a non-hostile vessel that surrenders should not be destroyed, left stranded, bankrupted, or subjected to similar actions. The safety of non-hostile commercial vessels must be guaranteed by all parties. Any vessel that is boarded in a hostile manner must first negotiate before any hostile actions are taken.

Warring Vessels

Warring vessels are ships used for warfare. They are governed by Nanotrasen's space law, but they also have the right to sovereign immunity. This means they cannot be searched or seized without consent from their flag state.

A warring vessel, or one operating under the flag of an enemy to Nanotrasen, is not protected by the same rules as commercial vessels. These flags include, but are not limited to, pirates, the Syndicate, the Wizards' Guild, or any imminently dangerous alien species, and these vessels would be classified as warring if they are within Nanotrasen's space and conducting hostile operations.

Anything involving illegal attacks on Nanotrasen personnel, property, or vessels will result in the classification of a ship as a warring vessel, and the NSFD (Nanotrasen Security Forces Division) has the right to use full force to stop the vessel if necessary.

Trial

👨‍⚖️

All employees charged with a crime have the right to a fair and speedy trial. The trial shall be conducted by an impartial judge and jury. The accused has the right to be represented by a lawyer, to confront witnesses, and to call their own witnesses.

In criminal cases, a trial cannot be requested when only misdemeanors are charged. The accused may request a trial when felony charges are brought, but they may be called to order at the discretion and ability of the potential judge. If the accused is charged with a capital offense, they have the right to a trial. Legal representation is not required to stand trial.

The trial format shall be an arbitration hearing, presided over by a judge, who is typically a station representative or sheriff. If no Frontier Command Staff are available but a trial must be held, it is permissible to grant a temporary promotion to the position of Head of Courtroom, with access and privileges equivalent to those of the sheriff, who shall lead the trial and be granted this assignment for the duration and purpose of conducting the trial.

In this hearing, the judge directly questions the accused and a representative from the prosecution side who is most familiar with the case to present their argument on why the accused should be acquitted or convicted of the charges. The trial is expected to last no longer than 20 minutes, with neither party having more than 6 minutes to present their case.

Extensions can only be requested with justification and granted at the judge's discretion. A conflict of interest can only be raised when it can be proven beyond reasonable doubt that the judge derives strictly personal gain from either ruling or when it can be proven that the prosecutor gains such benefit from an acquittal.

In the event that the defendant is held in contempt of court, the necessity of a trial may be waived, and a verdict may be rendered by the judge without a hearing.

Trials can also be held for civil disputes, requested by any crew member against another, preferably led by the sheriff or a station representative. In cases where the civil dispute involves a total value of 50,000 Spesos or more, a jury trial must be used.

Prosecution

Only NFSD or station administration can initiate prosecution against an employee for a crime. The prosecution must be in writing and must specify the crime that the employee is being charged with.

A person can be prosecuted for a crime if and when it can be argued beyond a reasonable doubt that they have committed an act of the nature and in the manner described by a specific criminal charge.

Multiple charges for the same crime can be prosecuted. For illegal actions against the station abroad, each incident separated by a reasonable period of inactivity, lawful behavior, or another crime is considered a separate charge. The same applies to crimes directly depriving a person (such as acts of violence, theft of personal property, etc.), with the additional stipulation that each victim counts as a separate charge.

Charges that are a direct escalation of one another in nature cannot be simultaneously held against the perpetrator if they pertain to the same incident and the same victim/item (if applicable). Then, only the most severe of these charges apply.

Sentencing

In sentencing a crime, it is recommended to defer to the Bailiff or Sheriff, however, any NFSD Deputy is authorized to pass a sentence. If none of either are available, any Station Representative may pass a sentence.

The precise sentence is determined by the person passing the sentence and is at their discretion, though may be overruled by one higher up Chain of Command. They are encouraged to use common sense in weighing the punishment against the severity of each charge separately as it is being applied, taking into account the broader circumstances of the crime and the modifiers further below.

  • In setting punishment, the charge with the highest minimum punishment is applied first (primary charge) by sentencing brig time anywhere from minimum to maximum of the primary charge, then every other charge sentenced applies at the minimum for each charge. (compounded charge).
  • Punishments outside of brig time (mind break, mandatory counsel) cannot be applied partially, save for Demotion. If listed as Minimum, they must be applied, whether primary or compounded. If listed as Maximum, it is applied at discretion.
  • If the total brig sentence would exceed 45 minutes, the NFSD is fully authorized and recommended to upgrade the sentence to Extended Confinement, regardless of any punishment limits.
  • Once the sentence commences, it must be concluded at or before the agreed time. The convict may be held responsible for any crime they commit while serving their sentence.

Sentence Modifiers

When applying charges, certain circumstances can apply, altering the severity of the punishment. In the event such circumstances would result in release or Extended Confinement, the sentencing should be deferred to the ranking member of the NFSD if at all possible.

Principals and Accessories to a Crime

A person who commits a crime is a principal. A person who helps or assists a principal in committing a crime is an accessory. Principals and accessories can be punished equally.

Self Defense

🛡️

Self-defense is a legitimate excuse for committing a crime. To claim self-defense, the accused must have had a reasonable belief that they were in imminent danger of death or serious bodily harm. The accused must also have used a reasonable amount of force to protect themselves.

Necessity

Necess-ity is a legitimate excuse for committing a crime. To claim necess-ity, the accused must have had a reasonable belief that committing the crime was necessary to prevent a greater harm. The harm prevented must be more serious than the harm caused by the crime.

Necessity

😨 Duress is a legitimate excuse for committing a crime. To claim duress, the accused must have been forced to commit the crime by another person. The accused must have had a reasonable belief that they would be killed or seriously injured if they did not commit the crime.

Aggravating Factors

⬆️ Aggravating circumstances are factors that make a crime more serious. Aggravating circumstances can include the fact that the victim was particularly vulnerable, that the crime was particularly brutal, or that the accused has a prior criminal history.

Mitigating circumstances

⬇️ Mitigating circumstances are factors that make a crime less serious. Mitigating circumstances can include the fact that the accused was young, that the accused had a mental illness, or that the accused was remorseful.

Fines

💸 A fine is a monetary penalty that can be imposed for a crime. The amount of the fine depends on the severity of the crime.

Seizure of assets

💰 Asset seizure is the seizure of property that has been used in the commission of a crime. Seized assets can be used to pay fines or compensate the victim of the crime.

Community Service

🧑‍🌾 Community service is a punishment that requires the convicted person to work for the community. The amount of community service required depends on the severity of the crime.

Treatment of prisoners

🔒 All prisoners shall be treated humanely and with dignity. Prisoners have the right to food, water, medical care and adequate sanitation. Prisoners also have the right to communicate with their lawyer and their family.

Extended isolation

Extended solitary confinement is a form of punishment that involves keeping a prisoner isolated from other prisoners for an extended period of time. Extended solitary confinement can only be used for a limited period of time and only if it is necessary to maintain order and security in the prison.
